Despite the fact that Liver Function Tests (LFT) and / or Urinary drug Screens (UDS) are neither mandatory nor a legal requirement (unless ordered by the Court), such biological markers are increasingly respected as an independent source of evidence of alcohol and / or other drug use. Significantly, these diagnostic tools along with other sources of evidence help Magistrates determine on the balance of probabilities the likelihood of a recurring offence. Consequently, these tests play a major role in the decision making process by Magistrates in granting or refusing an application for a Licence Restoration Order.
Accordingly, we would recommend in most cases that individuals applying for a Driving Licence Restoration Order undergo such tests and / or provide further independent evidence deemed by our experienced staff as necessary, relevant or helpful in achieving a positive outcome in such Court applications. In order to help our clients and minimise confusion in Court, www.05.com.au has established a simple and effective referral system. Thus, at no extra cost to our clients, our resident Biochemist can liaise with the General Practitioner for the purposes of performing, reporting and analysing these tests. A copy of the results are submitted to the Court to be used concomitantly and synergistically with a corresponding Licence restoration Report.
